General Terms & Conditions

1. Scope
These General Terms and Conditions ("GTC") apply to all orders placed through the online shops of ThePunShop.ch, Mürtschenblick 11, 8863 - Buttikon SZ, Switzerland. They regulate the rights and obligations between ThePunShop.ch and its Customers. Deviating terms and conditions require the written consent of ThePunShop.ch.
2. Services & Access to the Services
2.1 Services
ThePunShop.ch offers greeting cards ("Products") made in Switzerland for sale and operates an online business.
2.2 Product Customization
ThePunShop.ch offers the customization of selected Products on its website for an extra fee. The Customization is decided by the Customer via written confirmation to team@thepunshop.ch. The Customer is liable to provide the correct Product customization text desired in the written confirmation. ThePunShop.ch is not liable for Customer written errors and/or typos on their confirmation.
2.3 Access to the Services
The Customer may need to register an account to access and use all or part of the Services.

The Customer must provide accurate, current, and complete information during purchase and account creation and keep their account information up-to-date. Accounts registered by bots or automated methods are not authorized and will be terminated.

The Customer is responsible for maintaining the confidentiality and security of their account credentials and may not disclose their credentials to any third party. The Customer is responsible and liable for activities conducted through their account and must immediately notify ThePunShop.ch if there is any suspicion that their credentials have been lost, stolen, or their account is otherwise compromised.
3. Conclusion of Contract
By submitting an order in the online shop, the customer accepts the General Terms and Conditions. The contract is concluded upon confirmation of the order by ThePunShop.ch or, at the latest, upon delivery of the ordered goods.
4. Prices and Payment Terms
4.1 Prices
All prices are quoted in Swiss francs (CHF) and are inclusive of value added tax (VAT).
4.2 Payment
Payment is made by credit card via our website upon order placement.
5. Delivery and Shipping
5.1 Delivery Area
Deliveries are made exclusively within Switzerland and the Principality of Liechtenstein.
5.2 Delivery Partner
Delivery is carried out by the Swiss Post.
5.3 Shipping Costs
For Private Customer Orders:

B-post - cardboard envelope - up to 2 cards: CHF 1.50

B-post - cardboard envelope - 3 cards or more: CHF 2.50

Order value over CHF 30.00: Free shipping

For Business Customer Bulk Orders:

Business customer bulk orders (over 20 cards) are shipped as PostPac Economy with delivery confirmation via signature and tracking. Packages are charged by weight, as per the Swiss Post prices. Free shipping does not apply to the PostPac postage.
5.4 Delivery times

A-post: Orders are typically shipped within 24 hours, delivery can take between 1 and 2 business days

B-post: Orders are typically shipped within 48 hours, delivery can take between 3 and 5 business days

PostPac Economy: Bulk orders are typically whipped within 72 hours, delivery can take between 2 and 3 business days

ThePunShop.ch does not accept any liabilities for delivery delays caused by the Swiss Post.
6. Warranty and Liability
6.1 Inspection
The Customer is obliged to inspect the goods immediately upon receipt and to report any defects in writing within 7 working days.
6.2 Replacement Product
When a Product is confirmed as being sent as the incorrect ordered Product by the Customer or a defective Product, ThePunShop.ch will deliver a replacement selected Product to the Customer.

ThePunShop.ch is not liable to replace customized cards containing written errors and/or typos provided by the Customer on their email confirmation.

Customer must provide images of the product on its original packaging to establish the damage.
6.3 Liability
ThePunShop.ch is only liable for damages resulting from ThePunShop.ch’s gross negligence or intent. Further liability is excluded.
7. Data Protection
ThePunShop.ch collects and processes personal data as described in its Privacy Policy. ThePunShop.ch protects the collected personal data by means of appropriate technical and organizational measures and in accordance with the data protection legislation applicable in Switzerland and the European Union.
The Customer authorises ThePunShop.ch to use, process, and store relevant data for the performance of the Agreement and to use anonymized data to improve the Services or for analysis purposes.
8. Marketing and Newsletter
The Customer entitles ThePunShop.ch to use the Customer's testimonials for investment, advertising and marketing purposes, including showcasing it on ThePunShop.ch's Website and social media channels. Any other use requires the prior consent of the respective Customer. The consent should not be unreasonably withheld or withdrawn.

By signing up for ThePunShop.ch’s newsletter, the Customer agrees that ThePunShop.ch may contact them and inform them about updates on the Services and new Products and events from time to time. The Visitor can at any time unsubscribe from the contact list by sending an email to team@thepunshop.ch.
9. Miscellaneous
9.1 Governing Law & Jurisdiction
Governing Law & Jurisdiction: These Terms and Conditions, and all claims or causes of action that may be based upon, arise out of or relate to these Terms and Conditions shall be governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of law provisions, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
